These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “Customer,” or “Installer,” as applicable) and Install Genie LLC, a Texas limited liability company (“Install Genie,” “we,” “us,” or “our”), governing your access to and use of the Install Genie website, platform, scheduling tools, payment systems, communications, and related services.

By accessing or using the Platform, or by submitting an installation request or booking installation services, whether online, by phone, or via text message, you acknowledge that you have read and understood these Terms and agree to be legally bound by them. Where presented online, acceptance of these Terms may be confirmed by clicking to accept or agree. If you do not agree to these Terms, you may not use the Platform or book services.

Your use of the Platform is also governed by our Privacy Policy, Cancellation & Rescheduling Policy, and any additional policies referenced herein, each of which is incorporated into these Terms by reference.

Install Genie facilitates coordination and communication between customers and independent installers and follows its policies to facilitate resolutions where applicable.

1. Platform Role & Scope of Services

Install Genie LLC operates a technology platform that facilitates the scheduling, coordination, and payment processing of installation services performed by independent third-party installers (“Installers”) for customers (“Customers”).

Install Genie does not perform installation services and does not act as a contractor, subcontractor, employer, agent, or representative of any Installer. Each installation is performed by an independent Installer. Each installation constitutes a separate agreement solely between the Customer and the Installer performing the work. Install Genie is not a party to any agreement between the Customer and Installer and does not assume any obligations arising from such agreement.

Install Genie facilitates administrative scheduling coordination, collects payment from Customers through third-party payment processors (including Zenbooker and its integrated payment partners), and separately remits payment to Installers through independent payout systems in accordance with platform rules and applicable policies. Install Genie’s coordination is administrative in nature and does not include project management, supervision, or control over installation work.  Install Genie is responsible only for coordination and administrative services, and not for the performance or outcomes of installation services.

Install Genie may provide administrative support, documentation, general informational references, or coordination assistance to Installers. Any such support is general and non-binding in nature. Install Genie does not supervise, direct, or control installation methods, means, safety practices, or outcomes.

Install Genie may present installation opportunities to one Installer at a time based on internal criteria, but Installers independently decide whether to accept or decline any opportunity, and Install Genie does not control how installation services are performed.

Installers are solely responsible for determining all installation methods, techniques, safety practices, and compliance requirements. Installers must exercise independent judgment and shall not rely solely on any guidance, information, or materials provided by Install Genie.

References in these Terms to actions taken by Install Genie LLC mean actions taken through its authorized members, managers, officers, employees, or agents acting within the scope of their authority.

Install Genie may assist with coordination and communication if issues arise during or after installation and will follow its policies and make reasonable efforts to facilitate a resolution, which may include coordination, rescheduling, presenting the installation opportunity to one or more independent installers, or other appropriate outcomes depending on the circumstances. Install Genie does not guarantee any specific outcome or completion of installation services.

2. Independent Contractor Status

All Installers are independent contractors. Nothing in these Terms creates an employment relationship, joint venture, partnership, franchise, or agency relationship between Install Genie and any Installer.

Installers retain sole control over how installation services are performed and are solely responsible for all aspects of installation, including, without limitation:

  • Workmanship and quality
  • Safety practices and jobsite conditions
  • Code compliance, permitting, and inspections
  • Tools, equipment, and labor
  • Taxes, insurance, licensing, and legal compliance

Installers must exercise independent judgment in all aspects of installation services and shall not rely solely on any guidance, information, or materials provided by Install Genie.

Installers have no authority to bind Install Genie or represent themselves as employees, agents, or representatives of Install Genie.  Installers are not authorized to enter into agreements with customers on behalf of Install Genie.

3. No Responsibility for Workmanship, Permits, Products, or Compliance

Install Genie’s role is to facilitate connections and coordination between Customers and independent Installers, and the following limitations reflect that role. Install Genie is not responsible for:

  • Workmanship or installation quality
  • Code compliance, permits, or inspections
  • Jobsite safety or regulatory compliance
  • Structural integrity, site conditions, or access issues
  • Product defects, missing parts, or manufacturer instructions

Install Genie is not responsible for any bodily injury, personal injury, or death arising from installation services performed by independent installers.

Install Genie does not supervise, inspect, monitor, or verify installation work performed by Installers.

Install Genie may provide general, high-level informational content or suggestions related to installation services; however, any such information is provided for informational purposes only, is non-binding, and does not constitute instructions, supervision, direction, or approval of any installation method, technique, or decision. Install Genie does not provide installation instructions, and Installers must rely solely on their own independent judgment in determining all installation methods, techniques, and safety practices.

Install Genie does not evaluate, approve, or determine the suitability, safety, or appropriateness of any installation method or site condition and has no duty to identify hazards, unsafe conditions, or code violations or to prevent or stop installation work.

Install Genie does not provide warranties, guarantees, or assurances regarding installation outcomes. Installation outcomes do not constitute a failure of Install Genie’s services, which are limited to coordination and administrative support.

Install Genie does not manufacture, sell, distribute, or warrant any products being installed and is not responsible for product suitability, design, condition, or manufacturer documentation. Any warranties or remedies related to products or installation services must be pursued directly with the Installer, manufacturer, or retailer, as applicable.

Customers acknowledge that any information, recommendations, or guidance provided by Install Genie are non-binding, provided for general informational purposes only, and may not be relied upon for any installation, safety, or technical decisions, and that Install Genie does not supervise, direct, or control the Installer’s work. Accordingly, all installation methods, safety practices, and technical determinations are made solely by the Installer in their independent professional judgment.

Install Genie does not guarantee the performance, suitability, or qualifications of any Installer for any specific project. Customers should evaluate whether an Installer meets their needs, and Install Genie remains available to assist with coordination and communication as needed.

Install Genie’s responsibilities are limited to providing the Platform and facilitating coordination and payment processing. Install Genie does not assume responsibility for the performance of installation services.

Install Genie does not determine or verify the appropriate scope of work for installation. Any scope adjustments are identified based on installer assessment of actual site conditions and are administered through the Platform’s scope change process.

4. Installer Screening & Background Checks

Install Genie may require Installers to submit background checks, insurance documentation, licenses, or other credentials as a condition of platform participation. Such screening may include identity verification, criminal history checks, sex offender registry checks, and other risk-based screening criteria as determined by Install Genie in its sole discretion.

Install Genie reserves the right to approve, deny, suspend, or remove any Installer from the platform at any time based on screening results or other risk factors, in its sole discretion.

Install Genie may perform screening and onboarding of Installers as part of maintaining platform standards; however, any screening, verification, or credential review is limited in scope and does not constitute an endorsement, certification, or guarantee of an Installer’s competence, reliability, or performance.

Screening may be incomplete, outdated, or subject to error, and Install Genie does not guarantee the accuracy or completeness of any screening results.

Customers acknowledge that Installers are independent service providers and that they are responsible for determining whether an Installer is appropriate for their specific project.

Install Genie’s screening and onboarding process is designed to help maintain a high standard of service across the Platform. Install Genie aims to connect Customers with Installers based on available information and platform criteria, but does not guarantee the accuracy, completeness, or reliability of such information.

Install Genie may conduct periodic or continuous screening to maintain platform standards and eligibility requirements.

5. Pricing, Payments & Chargebacks

Pricing is based solely on the information provided at the time of booking and is not guaranteed if actual site conditions differ. A “change in scope” includes any difference between the original request and actual site conditions that affects parts, materials, components, labor, installation method, complexity, or pricing.

If a change in scope is identified, installation will not proceed under the original request. The original installation request will be paused or closed and will not be modified on-site under any circumstances.  Install Genie will issue a new installation request reflecting the updated scope and pricing. The Customer must review, approve, and complete payment for the new installation request before any additional work proceeds. The original installation request and any subsequent installation request are treated as separate and independent transactions, each subject to its own scope, pricing, and acceptance. Install Genie has no obligation to proceed with installation request under the original request if a change in scope is identified.  If the Customer declines to approve the revised installation request, the original installation request will be closed and no further work will proceed. Such outcome does not constitute a failure of service. No partial, modified, or alternative work is required or permitted under the original installation request if a change in scope is identified. A difference between the original request and actual site conditions is considered a change in scope, not a failure of service. Installers are not authorized to modify pricing, expand scope, or collect payment directly from Customers.

Optional services or add-ons selected at the time of booking are based on the information provided and do not guarantee suitability for actual site conditions, which may require adjustments to scope and pricing, including the issuance of a revised installation request

Customers acknowledge that payment processed through Install Genie is for platform-facilitated coordination, scheduling, and payment processing services, and not for the direct performance of installation services. Install Genie acts as a limited payment collection agent solely for the purpose of facilitating transactions between Customers and independent Installers. Payment processing by Install Genie does not create responsibility for or control over installation services. Install Genie’s role is to simplify the booking, coordination, and payment experience for Customers. Install Genie provides coordination and administrative support throughout the scheduling process.

Customers authorize Install Genie and its payment processors to charge the payment method on file for scheduled services, including applicable fees, taxes, adjustments, rescheduling charges, or cancellation fees where applicable.

Payments are processed through third-party providers. Install Genie does not store full payment credentials.

Install Genie collects payment as part of facilitating scheduling, coordination, and payment processing through the Platform. Installers earn payment for the services they perform, and Install Genie separately remits payment to Installers in accordance with platform rules and applicable policies. Install Genie does not sell installation services. Install Genie collects payment solely as a limited payment collection agent for coordination, scheduling, and platform services, and not as a seller of installation services or as a contractor for installation work.

Chargebacks, payment disputes, or suspected fraud may result in delayed, reduced, or reversed Installer payouts. Install Genie reserves the right to withhold funds, recover amounts previously paid, suspend accounts, or take other protective actions in connection with disputes or excessive chargeback activity.

Install Genie does not guarantee completion of installation services or any specific outcome as a condition of payment.

Cancellation and rescheduling fees are governed by the Install Genie Cancellation & Refund Policy, including the 72-hour cancellation window described therein.

Install Genie will not retain payment without providing coordination services or a reasonable opportunity for service completion or resolution in accordance with its policies, which may include continued coordination, rescheduling, presenting the installation opportunity to one or more independent installers, or other appropriate actions depending on the circumstances.

6. Customer Site Readiness & Access

Customers are responsible for providing accurate and complete information regarding the installation request, including product details, site conditions, measurements, and any relevant constraints.

Customers are responsible for ensuring that the installation site is accessible, safe, and ready for installation at the scheduled time, including providing necessary access, utilities, and a clear work area.

Install Genie does not verify site conditions, measurements, or readiness and is not responsible for delays, rescheduling, additional costs, or incomplete services arising from inaccurate information, site conditions, access limitations, weather conditions, or other factors outside of Install Genie’s control.

If actual site conditions differ from the original request in a way that affects scope, parts, materials, components, labor, installation approach, or pricing, such difference constitutes a change in scope and will be handled in accordance with Section 5 (Pricing, Payments & Chargebacks).

7. Communications & Scheduling

By using the Platform, you consent to receive communications from Install Genie, Customers, Installers, and platform partners via email, SMS, phone calls, or automated messages related to scheduling, service coordination, payments, and platform operations.

You agree that such communications may be sent using automated technology, including autodialers, automatic telephone dialing systems, and prerecorded or artificial voice messages, where permitted by law. You acknowledge that consent to receive such communications is not a condition of purchase.

You acknowledge that communications are provided for coordination purposes only and do not constitute guarantees, commitments, or assurances regarding scheduling, timing, availability, or completion of services.

Install Genie coordinates scheduling but does not guarantee Installer availability, appointment timing, or completion of services.

Use of the Platform may involve cookies and similar technologies as described in the Privacy Policy. Where required by applicable law, such technologies are subject to user consent through the Platform’s consent management tools.

8. Installation Media Consent

By submitting an installation request, Customer acknowledges and agrees that the independent Installer may capture photos and, where applicable, videos of the installation area and completed work for the purpose of:

  • Verifying completion of the requested installation
  • Facilitating coordination and communication
  • Supporting resolution under Install Genie policies
  • Maintaining platform records
  • Website content, advertising, social media, and other marketing or promotional purposes

Installers are expected to use reasonable judgment to limit media capture to the installation area and work performed and to avoid capturing unrelated personal or private information where reasonably practicable.

Install Genie may review installation media for administrative purposes, including completion verification, payout review, recordkeeping, customer support, dispute resolution, and marketing approval. Any such review does not constitute inspection, supervision, direction, approval, or warranty of the installation work, and the Installer remains solely responsible for all installation methods, safety practices, workmanship, and outcomes.

Install Genie will use reasonable efforts not to intentionally display unrelated personal, private, or sensitive information, including house numbers, license plates, people not relevant to the installation, or other identifying details, where reasonably practicable.

Use of such media is governed by the Install Genie Privacy Policy.

9. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Install Genie LLC, its members, managers, officers, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Installation services performed or received
  • Any acts, errors, omissions, negligence, or misconduct of any Installer or Customer
  • Breach of these Terms
  • Misrepresentations or inaccurate information provided by a Customer or Installer
  • Violations of law, code, or permit requirements
  • Property damage, personal injury, or third-party claims

This obligation applies regardless of whether Install Genie provided coordination, guidance, documentation, communications, or administrative support through the Platform.

This indemnification obligation does not apply to the extent that a claim arises from Install Genie’s gross negligence or willful misconduct.

10. Limitation of Liability & Damage Disclaimer

To the fullest extent permitted by law, Install Genie LLC and its members, managers, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of use, loss of value, loss of profits, or other economic losses, arising out of or related to the use of the Platform or any installation services.

Install Genie’s total liability for any claim arising out of or related to the Platform or these Terms shall not exceed the total amount paid by the Customer to Install Genie for the specific service giving rise to the claim.

Install Genie does not perform installation services and is not liable for the acts, errors, omissions, negligence, or misconduct of any Installer or Customer, or for any damages arising from installation services performed by Installers. All installation services are performed by independent third-party installers who are solely responsible for their work. Install Genie does not control or direct the manner, methods, or means by which any Installer performs installation services. Installation services are performed solely by independent installers, who are responsible for all aspects of such services. Nothing in this section limits liability to the extent such liability cannot be limited under applicable law, including liability arising from gross negligence or willful misconduct.

Customer acknowledges that certain insurance policies applicable to Install Genie, including professional liability coverage, may be written on a claims-made basis and require claims to be reported within specified timeframes.

To the fullest extent permitted by law, any claim, dispute, or cause of action arising out of or relating to the Platform, these Terms, or any installation services arranged through the Platform must be brought within six (6) months after the date of the final service visit, completion, cancellation, or resolution of the applicable installation request, whichever occurs first. Any claim not brought within this period shall be deemed permanently waived and barred. All disputes are subject to the time limitations set forth in these Terms.

11. Dispute Resolution & Arbitration

The party asserting a claim must provide written notice of the claim to the other party within a reasonable time after the event giving rise to the claim, and in no event later than thirty (30) days after discovery of the issue. Failure to provide timely notice may limit or bar the claim to the extent permitted by applicable law.

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms, the use of the Platform, or any services arranged through the Platform shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) in accordance with its applicable rules. This arbitration provision is a material part of these Terms and affects your legal rights. Install Genie aims to resolve issues in accordance with these Terms and applicable policies including taking steps in accordance with these Terms and applicable policies to address concerns before formal dispute resolution is required.

You acknowledge that this section requires the resolution of disputes through binding arbitration and includes a waiver of the right to participate in a class action. You may opt out of this arbitration provision by providing written notice to Install Genie within 30 days of accepting these Terms.

The arbitration shall be conducted on an individual basis and not as a class, collective, or representative action. To the fullest extent permitted by law, the parties waive any right to participate in a class action, collective action, or representative proceeding, and waive any right to a jury trial in any proceeding arising out of or relating to these Terms or the use of the Platform.

The arbitration shall take place in Texas, unless otherwise required by applicable law, and each party shall bear its own attorneys’ fees and costs except as otherwise required by law or determined by the arbitrator. Either party may bring an individual claim in small claims court where permitted by law.

12. Third-Party Services & Force Majeure

The Platform relies on third-party services, including scheduling, payment processing, communications, and background check providers, each governed by their own terms and privacy policies.

Install Genie is not responsible for outages, errors, data loss, delays, or service interruptions caused by third-party providers.

Install Genie shall not be liable for delays or failures caused by events beyond its reasonable control, including but not limited to weather, acts of God, labor shortages, supply chain disruptions, transportation delays, utility outages, illness, governmental actions, or emergencies.

13. Intellectual Property & Platform Ownership

The Platform, including all software, workflows, content, trademarks, branding, and technology (“Platform IP”), is owned by or licensed to Install Genie LLC and protected by applicable law.

Users are granted a limited, revocable, non-exclusive license to use the Platform solely for its intended purpose.

Users retain ownership of content they submit but grant Install Genie a limited license to use such content as necessary to operate, maintain, and improve the Platform.

Feedback provided to Install Genie may be used without restriction or compensation.

14. Termination, Suspension & Survival

Install Genie LLC may suspend, restrict, or terminate access to the Platform at any time, with or without notice, for violations of these Terms, suspected misuse, fraud, safety concerns, legal or regulatory compliance reasons, or conduct threatening platform integrity.

Install Genie may take such action where it reasonably believes suspension or termination is necessary to protect Customers, Installers, public safety, legal compliance, or the integrity of the Platform.

Termination does not relieve any obligations incurred prior to termination.

The following provisions survive termination:

  • Independent Contractor Status
  • No Responsibility, Warranties, or Guarantees
  • Indemnification
  • Limitation of Liability
  • Payments & Chargebacks
  • Dispute Resolution
  • Intellectual Property
  • Any provisions that by their nature should survive

15. Miscellaneous

Nothing in these Terms creates any personal liability for the members, managers, or owners of Install Genie LLC. All obligations and liabilities arising from use of the Platform are obligations of Install Genie LLC only.

These Terms constitute the entire agreement between the parties. If any provision is found unenforceable, the remainder shall remain in effect. Failure to enforce any provision is not a waiver.

Install Genie may update these Terms at any time by posting a revised version. Continued use of the Platform constitutes acceptance of updated Terms.
